General Terms and Conditions

Below are general terms and conditions you can use for your webshop. Please note: no rights can be derived from these terms and conditions. Consult a legal professional if you have doubts about their content.

Article 1 – Definitions

In these terms and conditions, the following terms are defined as follows:

  • Cooling-off period: The period within which the consumer can exercise their right of withdrawal.
  • Consumer: The natural person not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
  • Day: Calendar day.
  • Continuous transaction: A distance contract concerning a series of products and/or services, with the supply and/or purchase obligation spread over time.
  • Durable data carrier: Any means that allows the consumer or entrepreneur to store information personally addressed to them in a way that enables future consultation and unchanged reproduction of the stored information.
  • Right of withdrawal: The option for the consumer to withdraw from the distance contract within the cooling-off period.
  • Entrepreneur: The natural or legal person offering products and/or services to consumers remotely.
  • Distance contract: An agreement concluded as part of a system organized by the entrepreneur for distance selling of products and/or services, which uses one or more techniques for distance communication until the conclusion of the agreement.
  • Technique for distance communication: Means that can be used for concluding an agreement without the consumer and entrepreneur meeting simultaneously in the same space.
  • General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer by the entrepreneur and every distance contract and order concluded between the entrepreneur and the consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate, before the contract is concluded, where the terms and conditions can be consulted and that they will be sent to the consumer free of charge upon request.
  3. If the distance contract is concluded electronically, the text of these terms and conditions can also be provided electronically, in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, the entrepreneur will indicate where the terms can be accessed electronically and that they will be sent free of charge on request.
  4. If specific product or service terms are also applicable, the second and third paragraphs apply accordingly, and the consumer can always rely on the provision most favorable to them in case of conflicting terms.
  5. If any provision of these terms is found to be null or void, the remainder of the agreement and terms remain effective, and the provision will be replaced in consultation, as closely as possible, to the original intent.
  6. Situations not regulated by these terms must be assessed in the spirit of these terms.
  7. Ambiguities about the interpretation or content of one or more provisions should be resolved in the spirit of these terms.

Article 4 – The Offer

  1. If an offer has a limited validity or is subject to conditions, this will be explicitly stated.
  2. The offer is non-binding. The entrepreneur has the right to modify or adjust the offer.
  3. The offer contains a complete and accurate description of the offered products and/or services, providing sufficient details to allow a proper assessment by the consumer. Errors or obvious mistakes do not bind the entrepreneur.
  4. Images of products are truthful representations. However, the entrepreneur cannot guarantee that displayed colors match the exact product colors.
  5. The offer clearly states:
    • The price, including taxes.
    • Any shipping costs.
    • How the agreement will be concluded and which actions are required.
    • Whether the right of withdrawal applies.
    • Payment, delivery, and execution terms.
    • The validity period of the offer.
    • The cost of distance communication, if applicable.
    • Whether the agreement will be archived and accessible to the consumer.
    • How the consumer can rectify any errors before confirming the agreement.
    • Additional available languages for concluding the agreement.
    • Applicable codes of conduct and access methods.
    • Minimum duration for continuous transactions.

Article 5 – The Agreement

  1. The agreement is concluded when the consumer accepts the offer and meets its terms.
  2. If the consumer accepts electronically, the entrepreneur will confirm receipt of the acceptance promptly. Until this confirmation is received, the consumer may dissolve the agreement.
  3. For electronic agreements, the entrepreneur will ensure secure data transfer and a safe web environment.
  4. The entrepreneur may assess the consumer’s ability to meet payment obligations. If justified, the entrepreneur may refuse an order or attach special conditions.
  5. Upon delivery, the entrepreneur will provide:
    • Contact details for complaints.
    • Information on withdrawal rights or exclusions.
    • Guarantee and after-sales information.
    • Terms for contract termination (if applicable).

Article 6 – Right of Withdrawal

Consumers may cancel a purchase within 14 days without reason. During this period, products should only be handled to assess their desirability. Full details regarding usage, costs, and exclusions are outlined in the subsequent articles.
